3. Use of the Website and App

A. Eligibility

B. Analytics Services

7. User Content and Data

By using the App, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

Store, process, and display your content as necessary to provide the App's functionality

B. Product Data

8. Subscription and Billing

BUSINESS INTERRUPTION

COSTS OF SUBSTITUTE SERVICES

ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE WEBSITE OR APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

Any alterations to data on search engines, changes to search engine results (express or implied), or any impact on search engine optimization (SEO) or search rankings
Any events, issues, or consequences that occur inside your Shopify account, merchant account, or any other account or system, whether directly or indirectly related to the App
Any events, issues, or consequences that occur outside your Shopify store or website, including but not limited to impacts on third-party services, external websites, search engines, or any other systems or platforms
Any security breaches, hacking incidents, unauthorized access, data compromises, or other security-related issues affecting the App, regardless of whether such incidents result from vulnerabilities in the App, third-party services, or external attacks
Any loss, corruption, or unavailability of data stored or processed by the App, whether due to technical failures, security incidents, or any other cause

You acknowledge and agree that you use the App at your own risk and that EzTable / Booster Pack is not responsible for any consequences, damages, or losses that may result from your use of the App, whether such consequences occur within your Shopify account, on external platforms, or elsewhere.

13. Termination

We may terminate or suspend your access to the Website or App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

Your right to use the Website and App will immediately cease
We may delete or deactivate your account and all related information
We will retain your data according to our Privacy Policy and data retention practices

You may terminate your use of the App at any time by uninstalling it from your Shopify store. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Booster Pack operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Website or App shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration organization, except where prohibited by law. You waive any right to a jury trial and agree to resolve disputes on an individual basis.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

Posting the updated Terms on this page
Updating the "Effective Date" at the top of this page
Sending you an email notification (if you have provided an email address)
Providing notice through the App or Shopify admin panel

Your continued use of the Website or App after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Website and App and uninstall the App from your Shopify store.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Booster Pack regarding your use of the Website and App and supersede all prior agreements and understandings, whether written or oral.
